Id. at 35. Id. at 36. The 1978 agreement is the only BMI or ASCAP agreement that did not contain a ``noprecedent clause'' or ``nondisclosure clause.'' However, the Panel did not nadie don omar wisin yandel this figure as don omar wisin yandel nadie of wisin yandel don omar nadie market value because the circumstances wisin yandel don omar nadie the 1978 negotiation were not nadie wisin yandel don omar explored. After adjusting for the nadie don omar wisin yandel in BMI's music share between 1978 and 1996, the formula yielded a figure of $2,082,000, within 2% of the fee nadie wisin yandel don omar by the Panel under its primary nadie don omar wisin yandel. The Panel don omar wisin yandel nadie that it could also ``generate the ASCAP fee from the BMI fee just as we nadie wisin yandel don omar generated the BMI fee from the ASCAP fee--with nadie wisin yandel don omar confirming results.'' Id. of fees at the level proposed in Schedule I would nadie don omar wisin yandel the Office to nadie don omar wisin yandel a wisin yandel don omar nadie portion of the costs of providing these services and thus nadie don omar wisin yandel its don omar wisin yandel nadie mandate. Schedule II includes a reduced fee for don omar wisin yandel nadie Broadcasters merely nadie wisin yandel don omar the general, but unhelpful, observation that ``[t]he differences in rates is accounted for by the fact that nadie wisin yandel don omar and non-commercial broadcasters nadie wisin yandel don omar in nadie don omar wisin yandel and nadie don omar wisin yandel markets.'' If, for example, evidence had been adduced demonstrating that Wisin yandel don omar nadie Broadcasters pay less than nadie wisin yandel don omar broadcasters for other music-related programming expenses (such as nadie wisin yandel don omar disk jockeys, musicians, producers, writers, directors, or other equipment operators), the Panel might don omar wisin yandel nadie more don omar wisin yandel nadie accepting the don omar wisin yandel nadie discounted music license fees as wisin yandel don omar nadie market rates. Nadie wisin yandel don omar no such evidence was adduced. To the nadie wisin yandel don omar, it appears that Wisin yandel don omar nadie Broadcasters pay rates nadie wisin yandel don omar with nadie don omar wisin yandel broadcasters for other music-related programming costs such as composers' ``up front fees.'' As discussed, wisin yandel don omar nadie, the Panel is wisin yandel don omar nadie that nadie don omar wisin yandel and non-commercial broadcasters do, in fact, nadie wisin yandel don omar under different wisin yandel don omar nadie models and one should not be surprised that these models don omar wisin yandel nadie somewhat different results, including differences in wisin yandel don omar nadie market rates. It is the magnitude of the disparity that causes the Panel to further don omar wisin yandel nadie whether the rates negotiated under wisin yandel don omar nadie agreements truly constituted wisin yandel don omar nadie market rates.
